SCRA, And How Does It Really Work?

CS season is upon us and is in full swing! We wanted to take a moment to remind everyone of the steps you will need to follow if you plan to use the Servicemembers Civil Relief Act (SCRA) policy in North Carolina to break your lease. Please remember this is a federal policy and not a NEST policy and our goal is to educate you so there are no misconceptions or hard feelings when it comes time to turn in your orders and move to your next duty station.

If you are a military member, please note that you are covered under the Servicemembers Civil Relief Act (SCRA) policy in North Carolina. To terminate your housing lease, you or someone exercising a power of attorney on your behalf must submit a written notice of termination and a copy of your orders or a letter from your commanding officer to your property manager. Per the SCRA guidelines:

“If your lease requires monthly rent payments, termination of a housing lease is effective 30 days after the first date on which the next rental payment is due and payable after the date on which the termination notice is delivered.”

To make the process easier for you, we encourage you to submit your notice to vacate through your online portal. This will ensure that your notice is official and that it will be received and processed in a timely manner. If you have any difficulties accessing your portal, please do not hesitate to reach out to us, and we will be happy to assist you. At that same time, you will need to submit a copy of your official orders. Please keep in mind that we will review and verify your orders.

To terminate your lease early without penalty, notice cannot be accepted without orders, and that the notice to vacate officially starts when the orders are received. This means that if your lease expires on November 30th and you submit your notice with orders on May 3rd, you are responsible for rent until June 30th.
